SudzyBaby Terms & Conditions

 

1. General

Please read the following terms and conditions carefully, as they outline the agreement between the customer and SudzyBaby for any sales purchased through this website.

By choosing the "I accept" option located on or adjacent to the screen where this agreement may be displayed upon checkout from the SudzyBaby website, or by transmitting a purchase order via any other means, you agree to the terms below.

 

2. Prices and Taxes

Product prices are specified on the website at the time SudzyBaby receives the customer's order. Prices are subject to change at any time.

The customer shall pay all taxes, duties, levies or fees, or other similar charges imposed on SudzyBaby or on the customer by any taxing authority related to the customer's order, unless the customer has provided SudzyBaby with an appropriate resale or exemption certificate for the delivery location.

 

3. Customer Orders

Customer orders will be governed by these terms and are subject to acceptance by SudzyBaby. Orders must specify a shipping address regardless if local pickup is chosen.

Customer may cancel an order at no charge prior to the earlier of 2 hours after placing the order, or order processing and shipping. As SudzyBaby strives to ship all orders by the next business day, contact us as soon as possible for order cancellations. Orders that have started processing may be subject to a restocking fee.

 

4. Delivery

SudzyBaby will deliver products by arranging shipping to the delivery address as specified in the customer's order via the shipping method selected by the customer.

Transportation and handling charges are payable by the customer and will be specified in the invoice. In the case that shipping costs are discounted by SudzyBaby, the customer still assumes responsibility for shipping. Unless the purchase order states otherwise, all goods shall be shipped FOB shipping point. Shipments outside the contiguous United States and military APO/FPO addresses will receive a separate invoice for the difference in shipping costs over what is listed on the purchase order.

SudzyBaby shall not be liable for loss or damages resulting from SudzyBaby's failure to deliver, delays in delivery, or damages to deliveries, as a result of actions not within the control of SudzyBaby, fires, war, or acts of God.

Any claims as a result of loss or damage from shipping will be filed by the customer through the shipping carrier used for the purchase order. In the case that shipping insurance was not purchased, the customer assumes liability for loss and/or damage for all products as soon as they leave SudzyBaby.

 

5. Payment

Customer agrees to pay all invoiced amounts prior to delivery and acceptance of products. Except as otherwise stated in the purchase order, the price includes all applicable Federal, State, and local taxes and duties as regulated based on the delivery address provided by the customer.

 

6. Warranty

SudzyBaby expressly warrants all goods delivered under the purchase order to be free from defects in material and workmanship and to be of the quality, size, and dimensions ordered at the point of shipping.

Products manufactured and listed under the SudzyBaby name have a 60 (sixty) day warranty from the date of shipping. SudzyBaby will repair or replace any defects in workmanship not resulting from normal use, abuse, negligence, accident, loss or damage in transit, fire or water damage, or other causes beyond SudzyBaby's control. Warranty of SudzyBaby-branded products are transferrable to another party for the remainder of the warranty period.

Products manufactured and listed under names other than SudzyBaby but sold through this website are governed by their respective manufacturer warranties. Please contact SudzyBaby if you have any problems with non-SudzyBaby products and we will help you resolve your issues with the manufacturer. Warranty transfer of non-SudzyBaby-braded products are subject to the specific warranty details for the respective manufacturer.
